You can jailed 3 months if kill a puppy, like this man who punched a puppy to death when police arrived at his door has been jailed for three months. Andrew William Moylan — who has a prior conviction for killing a kitten — was handed a nine-week-old pomeranian from under a bed and began choking it after police arrived to retrieve the puppy for its owner.
Moylan, 33, from Stawell, then punched the dog repeatedly before handing it to police.
Police had been called to get the dog for its owner, who had been involved in an incident with Moylan earlier on January 11 this year. The puppy had been given to the woman as a Christmas present only weeks beforehand.
Moylan pleaded guilty to aggravated cruelty and beating an animal, but is appealing against his sentence.
Magistrate Tim McDonald, apart from sentencing Moylan to jail, banned him from being in custody of any mammal other than a human being.
Defence lawyer Ian Bruce told the court his client was aware he had a problem but, along with his counsellor and psychiatrist, had difficulty understanding it.
Moylan was released on bail pending the hearing of his appeal at the County Court in Horsham.
